A kebab shop owner who drove waste from his business around the corner to dump it outside a rival’s shop, has been found guilty at Birmingham Magistrates Court.
Mr Amjad Hussain, (48), who runs King Kebab on Kings Heath High Street, pleaded guilty to one offence under the Environmental Protection Act of dumping black bags of waste in York Road, Kings Heath.
He was fined a total of £3, 060 (£2, 500 plus £560 costs).
Following complaints from traders about black bin bags being dumped on York Road, Environmental Wardens from Birmingham City Council launched an operation in June 2009.
They observed a car leaving the High Street to dump rubbish in York Road on at least four separate occasions. Checks on the vehicle’s registration led wardens to Amjad Hussain.
Councillor Neil Eustace, Chair of the Public Protection Committee at Birmingham City Council, said:
“I have said before that we will not tolerate fly tipping in Birmingham. By dumping waste on his neighbours’ doorsteps, Amjad Hussain has shown complete disregard for both the law and his fellow traders.
“He has never provided Environmental Health Officers with any explanation for his behaviour, despite repeated invitations for him to do so.
“One can only assume that he was attempting to dodge paying for proper waste disposal, which was something of a pointless exercise, as he is now has to pay a substantial fine.”
